Fla. teeth-whitening company sued by state

CleanWhites and two affiliated companies that market teeth-whitening products are being sued by Florida Attorney General Bill McCollum's office over allegations that they enrolled consumers in a monthly subscription program without the consumers' knowledge or consent.

CleanWhites is affiliated with CleanWhites Pro and Advanced CleanWhites.

CleanWhites and owners Jesse Stein and Paul Nute advertised a "free trial" of teeth-whitening products that required consumers to only pay for shipping and handling, according to the attorney general's office. However, an investigation revealed that after consumers paid shipping they were enrolled in a subscription program that charged their credit cards $49.99 to $125 a month.

Further investigation revealed that the companies also provided the consumers' credit card information to additional Web sites selling similar products. Consumers complained they were billed for items never purchased and were regularly solicited for other items in which they had no interest. Hundreds of consumers have filed complaints about the companies' practices, according to the attorney general's office.

The lawsuit seeks injunctive relief, full consumer restitution, and, ultimately, a permanent injunction prohibiting all three CleanWhites entities and both owners from engaging in similar business practices in the future.
